Inheriting a Palm Coast house when you live out of state

SNS. Nakamura, October 21, 2026, 5 min read

Palm Coast is a retirement city. The median age is 50.4, about 30% of residents are 65 or older, and 37.7% of homeowners own their house free and clear. Many of those owners' children live in another state, so a son or daughter ends up inheriting a house in Grand Haven, Pine Grove or a gated 55-plus community such as Plantation Bay. Probate for a Flagler County resident is filed in the Seventh Judicial Circuit Court, Probate Division, at the Kim C. Hammond Justice Center, 1769 E. Moody Blvd, Building 1, in Bunnell. The case belongs in Flagler because that is where the person lived, not in the heir's home state. A Florida probate attorney files on the estate's behalf; ask which steps, if any, need you in Bunnell in person.

Summary administration: $150,000 for deaths on or after July 1, 2026

Florida has two main probate tracks. Summary administration is the short one. It is available when the estate, less exempt property such as the protected homestead, is $150,000 or less for deaths on or after July 1, 2026, $75,000 for earlier deaths, or when the person has been dead more than two years regardless of value. It is a court proceeding, not an out-of-court affidavit, and the court's order can convey real estate, including the homestead. Because the protected homestead is excluded from the count, a Palm Coast house that was the parent's primary residence does not by itself push the estate over the line, even at the city's median price of around $360,000. A will that directs formal administration bars the short track.

Formal administration and the personal representative

Larger estates use formal administration. The court appoints a personal representative, the Florida term for an executor, and issues letters of administration that prove that person's authority to act. The personal representative gathers assets, notifies creditors, pays valid claims and distributes what remains. Selling the house during formal administration is possible. If the will grants a power of sale, the personal representative can sign a contract. If it does not, the sale may need a court order. A cash buyer can often buy during an open probate by working with the personal representative, the estate's attorney and the title company. Homestead property has special protections for a surviving spouse and minor children, and the title company checks for them before closing.

Houses that skip probate

Not every inherited house goes through Bunnell. Three arrangements move title outside probate. A lady-bird deed, also called an enhanced life estate deed, lets the owner keep full control during life and names who takes the house at death without a court proceeding. A living trust that already holds the deed passes the house under the trust's terms, with the successor trustee signing the sale. Joint ownership with right of survivorship, common between spouses, leaves the house with the survivor. Florida has no transfer-on-death deed, so if a relative mentions one, they are thinking of another state. Before assuming probate is needed, pull the current deed from the Flagler official records (Recording, 386-313-4360) and read how title was held.

Homestead, Save Our Homes and the surviving spouse

If a spouse survives, Florida's homestead rules protect their right to the house, and the tax status stays with them. Save Our Homes caps the yearly increase in a homesteaded home's assessed value at 3% or the CPI change, whichever is lower. The homestead exemption removes $25,000 of value from all property taxes and another $25,000, on value between $50,000 and $75,000, from non-school taxes. A surviving spouse keeps the homestead and the cap. When the house is sold, the cap resets to market value the January 1 after the sale. A home held since the ITT years can carry a wide gap between assessed and market value, so the next owner's bill, at Palm Coast's 4.1387 city millage plus county and school rates, can be far higher than the parent's. Heirs who are not the spouse do not inherit the cap.

What an empty Palm Coast house costs while you decide

An inherited house in Palm Coast does not wait quietly. Insurance comes first. A typical Palm Coast premium is estimated near $2,260 a year, and carriers often refuse to write a roof older than 15 years, which describes many houses in the original lettered sections. Property taxes are due by March 31 and delinquent April 1, and the county sells a tax certificate on the unpaid bill on June 1. Code compliance runs on its own clock. Weeds and overgrowth have drawn $50 a day under Section 15-108(d) once a case reaches the Code Enforcement Board, nuisance accumulations $400 a day, and the owner is responsible for the swale under Section 24-159. Meanwhile Palm Coast homes took a median 79 days to sell in the 90 days to October 20, 2026, with 4.4 months of supply in Flagler County.

Closing from another state

A cash sale of an inherited house closes without the heirs traveling. The personal representative or trustee signs the deed and closing papers in front of a notary where they live, and the title company arranges the packet and its return. Title work confirms the probate order, the letters of administration or the trust, and any homestead issue. Palm Coast Cash Buyers buys inherited houses as-is and coordinates with the estate's attorney and the title company. We give a written offer within 24 hours of the visit, pay the customary closing costs, and can close in about a week once title is clear, which in a probate sale means once the court order or the letters are in hand. The estate's net is the price minus any mortgage payoff minus any liens. If the parent owned free and clear, like 37.7% of Palm Coast owners, that net is close to the price itself. Palm Coast Cash Buyers can also buy while probate is still open, so the sale does not have to wait for the final order.
